Federal appeals court finds client likely denied effective legal representation, halting deportation while case proceeds
TAMPA, Fla. - TelAve -- American Dream Law Office (ADLO) announced today that the U.S. Court of Appeals for the Eleventh Circuit has granted an emergency stay of removal for a client the firm took on after learning his prior attorney had failed to protect his right to challenge a removal order in federal court.
The court's order halts the client's deportation while it reviews the merits of his case. In granting the stay, the panel found that the client had made a strong showing that his previous counsel's handling of the matter fell below the standard required by law — and that, without a stay, he would lose his only opportunity to have his case heard.
"Every immigrant in this country is entitled to a lawyer who actually fights for them — not one who goes through the motions," said Ahmad Yakzan, founder of American Dream Law Office. "I know what it's like to come to this country and put your trust in the process. When that trust is broken by ineffective counsel, the consequences can be permanent. We stepped in, we fought, and the court agreed that our client deserves his day in court."

ADLO's appellate team moved quickly after being retained, filing the petition and emergency motion that led to the stay. The Eleventh Circuit agreed that the client had pursued his rights diligently and that the failures of prior counsel amounted to more than ordinary oversight — warranting relief rarely granted in immigration appeals.
Wins like this are uncommon. Federal appeals courts grant emergency stays of removal on ineffective-assistance grounds only in a narrow set of cases, and immigration appeals rarely succeed at the circuit court level. Securing this outcome required moving fast and persuading a federal panel that a client's due process rights had been compromised.
The case now returns to full briefing before the Eleventh Circuit, where ADLO will continue to represent the client on the merits of his petition for review.
"This is exactly why we built our appellate practice," Yakzan added. "Removal defense doesn't end at the immigration court. Sometimes the fight has to go all the way to federal court — and families need lawyers willing to take it there."
