Notaries Can Assist Individuals with Physical Limitations When Signing Legal Documents in Michigan

ANN ARBOR, Mich. - TelAve -- Individuals with physical disabilities or limitations who are unable to sign their own names may still legally notarize important documents under Michigan law. This provision, found in the Michigan Notary Public Act (MCL 55.293), allows a notary public to sign a document on behalf of a person who cannot physically execute their own signature.
The individual must direct the notary to sign their name, either verbally or through electronic communication if they cannot speak. The notary must then sign the document in the individual's presence and include the statement: "Signature affixed pursuant to Michigan Notary Public Act."
This legal accommodation ensures that individuals with mobility impairments, paralysis, arthritis, and other physical conditions can still complete important legal transactions, including estate documents, affidavits, and court filings.
Assisted signatures may be required for probate affidavits, settlement agreements, property transfer documents, and sworn statements submitted to the court.
