The last group reflects a shift in the liability landscape. In May 2026, the United States Supreme Court ruled unanimously in Montgomery v. Caribe Transport II that freight brokers can be held liable for negligently selecting unsafe carriers, a decision with direct consequences for Canadian brokers and shippers moving cross-border freight.
