Why States Have a Strong Case, Even Without Proving Addiction

WASHINGTON - TelAve -- With so many comparing the $1.4 trillion lawsuit against Meta to the very successful litigation against the major tobacco companies, the analysis of the Meta trial by "The Law Professor Who Masterminded Litigation Against the Tobacco Industry," who has also been called "a Driving Force Behind the Lawsuits That Have Cost Tobacco Companies Billions of Dollars," could help clear up some of the confusion.

Public interest law professor John Banzhaf, who played a major role not only in suing cigarette manufactures, but also in the formal determination that nicotine was addictive and caused addiction in many if not most of its users, says that the states have a strong case against Facebook and Instagram even if it can't be established that the social media platforms can be addictive like nicotine. . . .

Indeed, that exactly what the law professor predicted months ago: Lawsuits May Force Meta to Redesign Instagram an Expert Says (Banzhaf - "There's almost certainly going to be a vast avalanche of lawsuits. In the tobacco cases, you only had a limited number of potential plaintiffs").

The current Meta lawsuit, as well as the thousands of social media addiction lawsuits which have already been filed, are being compared to the highly successful litigation against cigarette makers who likewise denied that their product was addictive, and thought that the Surgeon General's warning - like Section 230 in the social media trials - protected them from liability.

But Banzhaf points out that plaintiffs in the tobacco cases used clever pleading and tactics to overcome the cigarette companies presumed legal immunity, and it looks like they are doing the same with regard to social media companies and their Section 230 arguments.. .

However, Prof Banzhaf notes out that the concept of addiction is complicated, and that there are important differences between addiction to nicotine in cigarettes and addiction involving social media. . .

In conclusion, the law professor cautions that jurors may not be particularly interested nor understand the complexities of defining and proving a true addiction.

Instead, as was the case with the tobacco companies which forced them to disgorge almost one-quarter of a TRILLION dollars, they will see rich and powerful companies which were well aware of the harm they were causing to children by a product which causes powerful addictive effects about which they even joked.
