Law Suit Threatened by Male Players; Likely to Succeed, Says Expert

WASHINGTON - TelAve -- Eight additional male basketball players - including 2 Former NBA players, 3 G-League players, and 3 European players - have joined the original three former NBA players who have announced they will seek to participate in the WNBA draft, and at least one has promised to sue if denied admission. . . .

Public interest law professor, who has won over 100 law suits alleging illegal sex discrimination against both male and female players, says any such law suit would have a good chance of succeeding.

The reason the WNBA will lose, the law professor says, is very simple.  Most of the WNBA teams play in states which have laws which expressly prohibit discrimination based upon gender identity (including specifically transgender status). . . .

So if an WNBA team in a state which prohibits gender-identity discrimination refused to permit White, Freedom, and other male contenders to become players because it decided that they were not truly transgender, it would seem to be a clear violation of state anti-discrimination law, and a slam dunk victory for the players.

On the other hand, if the WNBA deemed these NBA players (and others likely to join them) eligible for the WNBA draft - despite their outward appearances, including beards - as women, it would open the door to many other former NBA and male college players who could then join the WNBA's female teams simply by claiming that they are transgender, believe themselves to be female, have a female identity, want to be addressed as a woman, prefer female pronouns, etc.

Interestingly, in other situations, being eligible to compete as a female athlete hasn't required a male to even look, act, or dress as a female, since even guys with full beards have been permitted to compete as women.  In one case a 6 ft bearded volleyball player injured 3 girl athletes, and in another a bearded man entered a female powerlifting competition as a woman, and easily set a new powerlifting record.
