Hillary Herzig for Congress Demands Answers After Meta Advertising Account Blocked Over Reported $5.25 Balance; Campaign Raises Alarm Over Potential Election-Period Interference

Campaign Announces Preparation of Proposed $500 Million Lawsuit and Calls for Immediate Investigation into Restrictions Affecting Its Ability to Reach Voters

The congressional campaign of Hillary Herzig, Republican candidate for New Jersey's 6th Congressional District, is demanding immediate answers from Meta Platforms, Facebook, and Instagram after the campaign reports being unable to manage or resume advertising through its political advertising account because of an outstanding balance reportedly totaling just $5.25.

With Election Day approaching on November 3, the campaign considers the situation an urgent threat to its ability to communicate with voters during the most critical period of the election.

According to the campaign, its efforts to resolve the reported balance have not restored access to the advertising account. The campaign is demanding a clear explanation of the restriction, an immediate opportunity to settle any legitimate outstanding amount, and the restoration of its advertising capabilities without further delay.

"A $5.25 balance should not become an insurmountable obstacle to a congressional candidate's ability to communicate with voters in the final days before an election," said the Herzig campaign. "Our campaign deserves a straightforward explanation, a fair opportunity to resolve any legitimate billing issue, and equal access to the advertising tools available to political candidates. Every day this situation continues, our ability to reach voters is diminished."

SERIOUS QUESTIONS ABOUT TIMING AND POLITICAL FAIRNESS

Hillary Herzig is challenging incumbent Representative Frank Pallone Jr., who has served in Congress for 19 terms and is seeking a 20th term. The campaign believes that voters deserve a genuine opportunity to consider an alternative to decades of congressional incumbency and to evaluate the candidates' positions, records, energy, and plans for the future.

The reported advertising restriction has occurred during the final stretch of the campaign, when digital advertising can play an important role in informing voters, introducing candidates, and communicating campaign messages.

The timing has prompted serious concern within the Herzig campaign. The campaign is asking whether its advertising restriction is the result of an ordinary technical or billing failure, an administrative decision, or some other intervention. At present, the campaign says it has not received a satisfactory resolution.

The campaign is demanding transparency, not excuses.

Meta must explain precisely why the account has been restricted, identify the steps necessary to restore access, and provide a meaningful opportunity for the campaign to resolve the matter before voters go to the polls.

CAMPAIGN CALLS FOR INVESTIGATION INTO POSSIBLE POLITICAL INTERFERENCE

The campaign is also raising concerns about the concentration of political, business, and technology influence in the United States and the potential consequences when a major digital platform restricts a candidate's ability to communicate with the electorate.

Questions have been raised within the campaign about possible political connections involving Representative Frank Pallone Jr., his brother John Pallone, the Kushner family, President Donald Trump and members of his family, Meta leadership, and Elon Musk.

These concerns warrant examination where supported by evidence. However, the campaign has not established that any of these individuals directed, requested, or coordinated the advertising restriction. It is therefore calling for an impartial investigation into whether any political influence, improper intervention, or discriminatory treatment played a role.

The campaign believes that no candidate—Republican, Democrat, or independent—should have to wonder whether political connections or undisclosed outside pressure determine whether that candidate can advertise on a major digital platform.

If the restriction is a technical malfunction, it should be corrected. If it is an administrative error, it should be rectified. If evidence establishes deliberate political interference or discriminatory treatment, those responsible should be held accountable through appropriate legal and regulatory channels.

PROPOSED $500 MILLION LAWSUIT UNDER PREPARATION

The Herzig campaign announces that its legal team is preparing a proposed lawsuit seeking $500 million in damages, subject to legal review and the identification of viable claims and supporting evidence.

The proposed action is expected to examine the circumstances surrounding the advertising restriction, the campaign's efforts to resolve the reported balance, the financial and electoral consequences of any prolonged loss of advertising access, and whether any unlawful coordination or interference can be established.

Individuals and entities whose conduct may be relevant to the investigation, and whose inclusion would be supported by evidence and applicable law, may include:
  • Representative Frank Pallone Jr.
  • Long Branch Mayor John Pallone
  • Charlie Kushner, Jared Kushner, and Ivanka Trump
  • President Donald Trump, Eric Trump, and Donald Trump Jr.
  • Billionaire Tech Mogul Mark Zuckerberg
  • Meta Platforms, Inc.
  • Facebook and Instagram, subject to identification of the appropriate legal entities
  • Elon Musk

The campaign emphasizes that the proposed lawsuit is in preparation and has not been represented here as filed. The naming of an individual or company for investigation or proposed inclusion in litigation does not establish wrongdoing.

The campaign intends to pursue the matter through appropriate legal channels and to seek accountability if evidence establishes unlawful conduct.

THIS IS ABOUT MORE THAN $5.25

The issue confronting the Herzig campaign is not simply the amount of a disputed or outstanding balance. It is whether a candidate for federal office can be prevented from communicating with voters at a critical point in an election because of an account restriction that the candidate says it has been unable to resolve.

Digital platforms have become important channels for political communication. When access to those channels is restricted, particularly close to Election Day, the resulting consequences can extend beyond a campaign's finances to the ability of voters to hear competing viewpoints.

The Herzig campaign believes that electoral fairness requires transparent policies, consistent enforcement, timely dispute resolution, and meaningful avenues of appeal.

No political candidate should receive preferential treatment because of connections, and no candidate should be disadvantaged because of a platform's unexplained or improperly administered restrictions.

IMMEDIATE ACTION DEMANDED

The Herzig campaign calls upon Meta, Facebook, and Instagram to:

1. Provide a written explanation of the advertising-account restriction and the precise basis for the reported $5.25 balance.

2. Immediately provide a workable mechanism for the campaign to pay any legitimate outstanding balance.

3. Restore the campaign's advertising-account management and advertising capabilities as soon as the stated requirements are satisfied.

4. Preserve relevant account records, billing information, restriction notices, internal communications, and other materials relating to the restriction.

5. Provide an appropriate review of whether the campaign has been treated consistently with the platforms' published policies and applicable law.

6. Cooperate with any lawful investigation into credible evidence of political interference or discriminatory treatment.

The campaign also calls upon appropriate election officials, regulators, and members of Congress to consider whether additional scrutiny is warranted if evidence suggests that a digital platform has improperly interfered with a candidate's ability to communicate with voters.

A CALL TO PROTECT THE INTEGRITY OF THE ELECTION

Hillary Herzig's campaign maintains that voters—not technology executives, political insiders, the billionaire class, or powerful private interests—must ultimately decide the outcome of the November 3 election.

The campaign is seeking a prompt resolution, a transparent accounting of what occurred, and a fair opportunity to communicate its message to the people of New Jersey's 6th Congressional District.

The campaign will continue documenting its efforts to regain access, evaluating the available legal remedies, and seeking answers about the circumstances surrounding the restriction.

The public deserves answers. The campaign deserves fair treatment. And voters deserve the opportunity to make an informed choice. No candidate, not even Frank Pallone, has the right to dismantle our democracy and attack the process that gives voters a fair chance to select their representation.
