LAS VEGAS - TelAve -- Today, John Waudby, founder of Nevada Animal Advocates, announced the formal submission of a proposed sentencing statement to the Clark County District Attorney's office. The advocacy group is requesting that the statement be officially included in the Presentence Investigation (PSI) report presented to Eighth Judicial District Court Judge Jacqueline Bluth ahead of the upcoming sentencing hearing for Mitchell Fairbarn.

Fairbarn, a Canadian tourist, was recently convicted by a Clark County jury on both felony and misdemeanor animal cruelty charges following a four-day trial. The charges stem from an incident at the Flamingo Las Vegas Hotel & Casino wildlife habitat, where Fairbarn captured, taunted, and severely injured "Peachy," a 27-year-old Chilean flamingo.

Nevada Animal Advocates strongly urges the court to hand down the maximum prison sentence permitted under Nevada law. The organization highlights the willful, deliberate nature of the abuse and draws attention to Fairbarn's own trial testimony, in which he chillingly described the torture of the defenseless bird as a "joke" he wanted to remember for the rest of his life.

"Visiting Las Vegas does not give anyone license to terrorize the animals who live here," said John Waudby, founder of Nevada Animal Advocates. "Peachy was not a prop for a joke or a souvenir to carry back to a hotel room—she is a living creature who suffered deeply. The defendant's complete lack of remorse demands meaningful consequences. We are calling on the court to enforce the full weight of the law to show that animal cruelty carries severe penalties in the State of Nevada."

Waudby, who previously championed the passage of Reba's Law in Nevada to strengthen state animal welfare penalties, noted that meaningful prison time is vital to honor the legislative intent of protection for vulnerable animals.

The formal sentencing hearing is scheduled to take place before Judge Jacqueline Bluth on December 1. Nevada Animal Advocates has also launched a petition on its website asking the judge to impose the maximum sentence.
