Segregated Funds for Estate Planning in Vancouver: Can They Bypass Probate?

TelAve News/10910548
For families with parents over 50, beneficiary designations on insurance-based investments may simplify wealth transfer—but the details and provincial rules matter.

VANCOUVER, British Columbia - TelAve -- When a parent dies, families often discover that estate planning is not only about who inherits. It is also about how quickly assets can move, how much administration is required and whether beneficiaries were properly designated.

SEGREGATED FUNDS HAVE AN ESTATE-PLANNING DIFFERENCE

A segregated fund contract is issued by a life insurance company. When an eligible beneficiary is properly named, the death benefit can generally be paid directly to that beneficiary instead of flowing through the estate.

In many cases, that can reduce probate exposure, speed settlement and provide greater privacy. The result can be particularly useful when a family wants certain investment proceeds to reach a spouse, child or other beneficiary directly.

THE GUARANTEE CAN MATTER TOO

Segregated fund contracts also include death-benefit guarantees, commonly 75% or 100% depending on the contract. If markets fall sharply before death, the guarantee may help protect part or all of eligible deposits, subject to withdrawals and contract terms.

PROBATE BYPASS IS NOT AUTOMATIC

Beneficiary wording, account registration, ownership structure and provincial law matter. Naming the estate as beneficiary can produce a different result. Creditor protection is also conditional and should never be assumed.

Families should coordinate investment contracts with wills, powers of attorney, tax planning and professional legal advice.

ESTATE PLANNING IS ABOUT THE PATH, NOT JUST THE DESTINATION
